  1. Ownership of Proprietary Material: All content, graphics, and structures embodied within this work—including but not limited to written lesson plans, curriculum architectures, digital PDF files, multimedia assets, audio-visual recordings within our streaming library, and all hand-drawn or digitally rendered custom imagery, illustrations, and designs—are the exclusive intellectual property of Fun Art Box®, LLC. This content is rigorously protected under the United States Copyright Act (17 U.S.C. § 101 et seq.), international copyright treaties, and all applicable intellectual property jurisdictions.
  2. Grant of Limited License: Purchase or authorized acquisition of these materials grants the individual end-user a restrictive, non-exclusive, non-transferable, revocable, single-user license. This license authorizes exactly one (1) educator within one (1) physical brick-and-mortar classroom, one (1) individual charter school instructor, one (1) individual homeschool teacher, or one (1) individual household to reproduce physical student handouts (specifically color lesson images, coloring sheets, and step-by-step guides) solely for the direct, in-person instruction of immediate students or children within that single room or household.
  3. Explicit Prohibitions & Anti-Piracy: Any distribution, replication, modification, or transmission of these materials outside the scope of Section 2 is strictly prohibited.
  • Digital & Broadcast Prohibition: You shall not upload, host, or transmit these digital files to shared school district servers, public cloud environments, or drop-boxes. You shall not stream, loop, broadcast, or display our video or audio media within online virtual classes, remote-learning portals, or video-conferencing networks (e.g., Zoom, Microsoft Teams).
  • Commercial & Derivative Prohibition: There shall be no monetization or profit-generating use of these materials. You are strictly prohibited from using these resources to host or conduct for-profit workshops, child or adult clinics, camps, or tuition-based online classes. You may not extract or separate our custom-designed imagery from the text to create derivative works, portfolios, or commercial products.
  • Artificial Intelligence (AI) Training Ban: You are explicitly denied permission to download, scrape, ingest, or utilize any text, graphics, videos, or illustrations from Fun Art Box®, LLC for the purposes of training, testing, developing, or fine-tuning machine learning models, artificial intelligence algorithms, or generative image systems.
  1. Enforcement & Statutory Remedies: Fun Art Box®, LLC actively monitors the digital marketplace and educational sharing networks for piracy. Any material breach of this covenant immediately revokes your license without notice or refund. Fun Art Box®, LLC reserves the right to pursue full legal remedies under federal law, including seeking statutory damages up to $150,000 per willful infringement, permanent injunctive relief, court costs, and reasonable attorney's fees.

Acceptance of Terms

    • Agreement Overview:  Statement that using the site, accessing the video library, or placing an order constitutes legally binding acceptance of these terms.

  1. Ownership of Content

All content created, designed, and published by Fun Art Box®, LLC is the exclusive intellectual property of the creator and is protected under international copyright laws. This comprehensive protection extends to all formats, including but not limited to:

  • Printed & Digital Media: Curriculum guides, workbooks, lesson plans, Google Slide decks, educational resources, coloring pages, and coloring books.
  • Artwork & Visuals: All hand-drawn and digitally created custom images, illustrations, graphics, and designs featured on our website, marketing materials, within our curriculum, or printed on posters and art canvases.
  • Multimedia: All video content, audio files, and material contained within our video library.

1.1  FORMAT-SPECIFIC INTELLECTUAL PROPERTY PROTECTIONS

1.1a  Literary & Educational Compilations (Fun Facts & Art History Sheets)

Fun Art Box®, LLC asserts full copyright ownership over the specific expression, selection, coordination, and arrangement of all "Fun Facts" sheets, "Art History" guides, and written educational curricula. While historical facts and data points remain in the public domain, the proprietary layout, graphic design, specific phrasings, and creative compilation of these facts constitute original "literary and visual works" protected under 17 U.S.C. § 101. Unauthorized photocopying, scanning, or digital reproduction of these layouts is strictly prohibited.

1.2a  Audio-Visual Works & Read-Aloud Performances

Fun Art Box®, LLC retains exclusive "performance rights" and "sound recording copyrights" for all "Read-Aloud" videos, audio narrations, and instructional clips. Your single-user license grants you the right to view these performances in a private or classroom setting only.

  • Strict Broadcast Prohibition: You may not broadcast, rebroadcast, stream, or publicly perform these Read-Alouds over the internet, including via YouTube, Zoom, Facebook Live, or public school district networks.
  • No Audio Extraction: You may not separate the audio narration from the video file to create standalone audiobooks or sound files.

1.3a  Original Visual Art & Digital Images

All hand-drawn images, coloring page designs, and digital canvas previews are protected as "pictorial, graphic, and sculptural works." You may not trace, vectorize, or alter these images to create derivative works (e.g., turning our coloring page line art into an SVG for a vinyl cutter) without express written permission.

  1. Authorized Grant of License (Single-Use, Non-Profit Only)

By purchasing, downloading, or receiving these materials, charter schools, homeschools, school districts, individual teachers, and parents/guardians are granted a limited, non-exclusive, non-transferable, single-use license under the following strict conditions:

    • Classroom Use: Individual teachers may use these materials solely for the instruction of students within their physical classroom.  Designated virtual non-profit classrooms can use the materials with written permission from Fun Art Box®, LLC.
    • Home Use: Parents and legal guardians may use these materials solely for the education of children within their own household.
    • Strictly Non-Profit: All use must occur strictly within a non-profit learning environment.

  • By accessing the site or by using Fun Art Box®, LLC’s copyrighted materials, you agree not to share our copyrighted materials, including but not limited to printed, digital, and video formats.   You are responsible for keeping your account and login information confidential, or we reserve the right to immediately revoke your access to Fun Art Box.

2.1 Single-User Individual Classroom & Household Exception

Subject to the strict limitations in Section 3, a limited, non-transferable, single-user license is granted exclusively to one (1) individual educator in one (1) physical brick-and-mortar school location, one (1) individual charter school teacher, one (1) individual homeschool teacher, or one (1) individual household.

Under this single-user exception, the individual licensee has explicit permission to print and duplicate physical student handouts directly from the curriculum materials. This authorized printing is strictly limited to the following items:

  • Full-Color Lesson Images: Physical prints of lesson visuals to display to students within the physical room.
  • Full Coloring Sheets: Physical coloring pages for individual student use during the activity.
  • Step-by-Step Handouts: Physical instructional worksheets to guide students through the art project.

2.2  Absolute Prohibition on Digital and Broadcast Distribution

The permissions granted in Section 2.1 apply exclusively to physical, in-person instruction within that single designated room or household.

Under no circumstances shall any licensee without written permission from Fun Art Box®, LLC—including but not limited to any individuals, teachers, districts, or parents—upload, stream, broadcast, or display these written, digital, video, or audio materials within:

  • Any Online Class: Including but not limited to virtual classrooms, remote learning platforms, Zoom/Teams calls, or pre-recorded digital lessons without written permission from Fun Art Box®, LLC.
  • Mass Multi-Classroom Settings: Broadcasting the video, audio, or digital content across multiple classrooms simultaneously, even if hosted within the same brick-and-mortar building, without written permission from Fun Art Box®, LLC.
  1. Prohibited Commercial & For-Profit Uses

Any commercial use, monetary exploitation, or profit-generating activity involving these materials is strictly prohibited. Prohibited actions include, but are not limited to:

  • Paid Workshops & Classes: Using any part of this curriculum, curriculum structure, artwork, canvases, or video library to host or conduct for-profit workshops, camps, clinics, or classes for children or adults.
  • For-Profit Online Teaching: Utilizing these resources to teach online courses, tutorials, or programs that generate revenue, subscription fees, or tuition profit.
  • Commercial research, data mining, or computational analysis without express written consent constitutes a severe violation of this copyright.
  1. Strict Artificial Intelligence (AI) Training Ban

No part of our proprietary content, custom hand-drawn illustrations, digital graphics, layout designs, curriculum structures, text, audio files, or video materials may be scraped, downloaded, or extracted for any computational purposes. You are explicitly prohibited from utilizing our assets to train, develop, validate, or fine-tune artificial intelligence (AI) models, machine learning algorithms, or generative image/art systems. Any such data mining constitutes a material breach of copyright law.

  1. Distribution & Piracy Restrictions
  • No Unauthorized Sharing: Digital files and video access tokens may not be uploaded to shared school district servers, public cloud drives, torrent networks, or social media groups.
  • No Derivative Works: You may not alter, transform, build upon, or separate the custom images from the text to create new commercial products.
  1. Term Enforcement, Remedies, & Modifications

Unauthorized duplication, distribution, or commercial exploitation of these materials constitutes copyright infringement and piracy. Fun Art Box®, LLC reserves the right to pursue all legal remedies, including seeking statutory damages, court costs, and immediate injunctive relief to halt unauthorized operations.

  • Remedies for Infringement: Any unauthorized digital distribution, multi-user license sharing, for-profit implementation, commercial exploitation, or AI scraping of these materials constitutes copyright infringement and piracy.  Any of these will result in the immediate revocation of your license and digital access portals. We reserve the right to pursue full legal remedies, including seeking statutory damages up to $150,000 per violation, attorney fees, and immediate injunctive relief.
  • Right to Modify: These terms of service are subject to change by Fun Art Box ®, LLC at any time and at our discretion without notice by updating this posting. Updates will be signaled via our website with an amended "Last Updated" date, and continued usage of your assets constitutes full acceptance of the updated terms.  These terms of service govern your use of this website and any content contained therein. By accessing this website, you acknowledge and accept these terms of service.  Your use of this website after any changes are implemented constitutes your acceptance of the changes. As a result, we encourage you to consult the terms of service each time you use this website.
  1. Orders, Pricing & Payments
  • Order Acceptance: Policy clarifying that order confirmation does not guarantee fulfillment until payment is processed and the order is formally accepted.
  • Billing Terms:
    • Access to Video Library Content will be emailed within 5 business days after payment is received and processed.
    • Annual Subscription price is guaranteed for one year.
    • Recurring monthly payments will be processed on the 1st of the month.
    • By accepting our Terms & Conditions, you authorize Fun Art Box®, LLC to bill you monthly or annually for video library subscriptions.
    • Orders for monthly or annual subscriptions will renew automatically unless you notify Fun Art Box®, LLC via email at [email protected]
    • Cancellation Policy: You may cancel your streaming video library portal access or subscription at any time through your account dashboard or by emailing [email protected].
    • Access Upon Cancellation: Once you submit a cancellation request, you will retain full access to the video library until the end of your current paid billing cycle (monthly or annual). Your access will automatically terminate at the conclusion of that cycle, and no further charges will be processed. 
    • No Prorated Refunds: We do not issue partial or prorated refunds for unused time remaining in a billing cycle after a cancellation request has been submitted.
    • Declined Credit Cards:  We will withhold delivery, request an alternate form of payment, or cancel the transaction.
  • Taxes & Fees: Customer is responsible for applicable sales taxes and international customs (if applicable).
  1. Fun Art Box®, LLC Custom Paint Kits
  • Disclosure:  Fun Art Box Custom Designed Educational 4 Pack Paint Kits are packed and shipped exclusively by Fun Art Box®, LLC. This is NOT an Affiliate relationship.
  • Limitation of Liability: We purchase art supplies that carry the ACMI Art & Creative Materials Institute Certification that conforms to ASTM D4236.  “The Approved Product (AP) seal certifies that a tested product is non-toxic and safe when used as directed.  These products are safe for all ages and encouraged for use in classrooms.   Any customer service inquiries, damages, missing items, or refunds regarding physical kits must be directed solely to Fun Art Box®, LLC.
  • Product Descriptions: Details verifying that colors, materials, and contents of physical paint kits may vary slightly from catalog or website imagery.
  • Availability: Right to modify, limit, or discontinue art kits or printed materials at any time.

8.1  Third-Party Products and Affiliate Programs

Our website also features links to an external, third-party affiliate program to facilitate the easy purchase of bundled art supplies and physical art kits.

  • Independent Policy Notice: Third-party recommended, pre-bundled physical art supply kits (paints, brushes, tools, etc.) are sold, packaged, fulfilled, and shipped entirely by an independent, third-party vendor program.
  • Exclusion of Liability: Fun Art Box®, LLC does not handle inventory, process returns, or issue refunds for physical art supply kits. All cancellations, shipping delays, missing items, returns, or refund requests regarding these supplies are governed exclusively by the third-party merchant's respective return policy.
  • Customer Service: Please contact the third-party vendor directly using the customer service contact information provided on your kit's packing slip or receipt.
  • Limitation of Liability: We make no warranties, express or implied, regarding the fulfillment, shipping speed, item quality, or safety of products purchased via third-party affiliate links. Any customer service issues, returns, damages, or refund requests regarding your physical art supplies must be directed entirely to the third-party vendor, not to Fun Art Box®, LLC.

8.2   Third-Party Art Kits & Financial Disclosure:

To simplify your classroom preparation, this curriculum recommends specific, pre-bundled art supply kits. These physical kits are sold, packaged, and shipped entirely by an independent, third-party affiliate vendor. Please be advised that Fun Art Box®, LLC receives a small financial commission or referral fee when you purchase these kits through our designated affiliate links. We are not the manufacturer or distributor of these physical goods. Any customer service inquiries, shipping delays, defective items, or refund requests regarding physical art supplies must be directed exclusively to the third-party merchant.

8.3   Third-Party Data Sharing & Affiliate Tracking

We utilize tracking links and browser cookies to facilitate our third-party art supply affiliate
program.

  • How It Works: When you click on an art supply kit link on our website, a secure cookie is temporarily placed on your browser. This cookie signals to the third-party vendor that you were referred by our site so that we may earn our small commission.
  • Data Privacy: This tracking process does not share your sensitive personal information (such as your address, credit card numbers, or student data) with the third-party network. 8.4  Safety & Accessibility Commitments

  • Adult Supervision Required: Art creation involves sharp tools and liquid media. We disclaim all liability for injuries or property damage. Instructors and parents must provide continuous supervision.
  • ADA Standards: Our digital resources strive to meet ADA and WCAG 2.1 Level AA compliance, featuring closed-captioned video content and screen-reader-optimized digital layouts.
  1. Digital Accessibility, WCAG 2.1 Compliance, and Assistive Metadata

Fun Art Box®, LLC values inclusion and continuously works to align its digital assets with the Americans with Disabilities Act (ADA) and WCAG 2.1 Level AA standards.
Digital Accommodations: Our online video library features synchronized closed captioning, and our digital PDFs are built with reading hierarchies and alt-text descriptions where technically feasible.

9.1 Compliance Covenant: Fun Art Box®, LLC is committed to facilitating the accessibility and usability of its digital platform, streaming video library, and downloadable digital media assets (including coloring sheets, step-by-step guides, and curriculum PDFs) in accordance with Title III of the Americans with Disabilities Act (ADA) and the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards, as promulgated by the World Wide Web Consortium (W3C).

9.2 Alternative Text (Alt-Text) Mandate: Pursuant to WCAG Success Criterion 1.1.1 (Non-text Content), all non-text materials—including but not limited to hand-drawn images, custom graphics, canvas kit previews, and instructional diagrams authored by Fun Art Box®, LLC—are embedded with descriptive, non-textual programmatic alternatives ("Alt-Text"). This text is specifically engineered to render textual equivalence of visual assets for delivery via assistive technologies, such as audial screen readers utilized by visually impaired individuals.

9.3 Time-Based Media (Captions and Subtitles): In strict accordance with WCAG Guideline 1.2, all streaming media and audio-visual presentations contained within the Fun Art Box®, LLC Video Library feature synchronized, time-coded text captions and subtitles. These text alternatives provide programmatic descriptions of auditory content, spoken instruction, and visual scene changes to ensure comprehensive access for deaf, hard-of-hearing, and low-vision consumers.

9.4 Anti-Tampering of Accessibility Metadata: Licensees are strictly prohibited from stripping, deleting, modifying, or separating embedded Alt-Text metadata, closed-caption files, or accessibility tag structures from any Fun Art Box®, LLC file, PDF, or video stream. Removal of accessibility structures constitutes a material violation of these Terms and revokes the authorized user license immediately.

9.5 Digital Library & Video Content Accessibility:  We are actively working to ensure our online digital portal and streaming video media meet high accessibility standards through the following implementations:

  • Closed Captioning (CC): All core instructional videos within our video library feature synchronized closed captions and text transcripts for deaf or hard-of-hearing users.
  • Audio Clarification: Instructional videos are recorded with high-contrast, clear audio narration to assist visually impaired or neurodivergent learners.
  • Platform Compatibility: Our digital video player supports standard assistive keyboard controls (e.g., play, pause, and volume adjustment without requiring a mouse).

9.6. Printed Books, Learning Guides, & Digital PDFs:  Our educational publishing layouts are optimized to improve readability and support assistive learning tools:

  • Screen Reader Optimization: Our digital curriculum PDFs are structured with clear heading hierarchies, metadata, and Alt-Text (alternative text descriptions) for embedded custom images and hand-drawn illustrations.
  • Typography & Layout: Printed curriculum materials utilize high-contrast layouts and clean, legible fonts to support educators and students with dyslexia or visual impairments. 

9.7. Physical Art Tools, Canvases, & Kit Accommodations:  We recognize that the tactile creation of art presents unique physical demands. Physical components can be modified upon request.  We recognize the importance of inclusion and, upon request, will include adaptive art materials to meet individual needs.

  • Tactile Design: Our custom-printed canvases utilize clear, high-contrast, bold black outlines to assist students with low vision or spatial tracking difficulties.

9.8. Continuous Improvement & Feedback Request:  Accessibility is an ongoing journey. If you encounter any barriers while navigating our website, viewing our video library, or using our physical books and art canvases, please contact us immediately. Art creation involves tools and materials—such as scissors, paints, glues, clays, and specialized utensils—that require age-appropriate handling.

Fun Art Box®, LLC explicitly disclaims any liability for injury, allergic reaction, property damage, or loss sustained by any individual, student, educator, or parent while participating in the activities outlined in these materials. Adult supervision is strictly required at all times. It is the sole responsibility of the educator, school, or parent to ensure that all art supplies used are non-toxic, age-appropriate, and handled in a safe learning environment.

  1. Safety, Supervision, & Physical Liability Waiver

Art creation inherently involves tools and materials (including but not limited to scissors, paint media, specialized brushes, and clays) that require responsible handling.

  • Supervision Mandate: Continuous, age-appropriate adult supervision is strictly required at all times during the execution of our lessons.
  • Waiver of Liability: Fun Art Box®, LLC explicitly disclaims any and all liability for personal injury, allergic reaction, chemical sensitivities, property damage, or financial loss sustained by any student, teacher, or parent while interacting with our materials or recommended supplies. It is the sole responsibility of the educator or parent to verify that all materials used are non-toxic, safe, and handled appropriately.
  1. CANCELLATION & RETURN POLICY

Thank you for partnering with Fun Art Box®, LLC for your art education needs. Please read this policy carefully before making a purchase. Because our curriculum is delivered across multiple digital and physical formats, specific cancellation and return rules apply to each product type. 

Digital Downloads & PDF Curriculum Guides

  • All Sales Are Final: Due to the immediate access and digital nature of our downloadable curriculum files, lesson plans, coloring sheets, and step-by-step PDF handouts, we do not offer refunds, returns, or exchanges once a purchase is completed.
  • Piracy Protection: Digital assets cannot be physically returned or locked once downloaded. If you experience technical difficulties downloading or opening your files, please contact our support team at [email protected], and we will gladly assist you in accessing your purchased materials. 

Online Video Library Access & Subscriptions

  • Cancellation Policy: You may cancel your streaming video library portal access or subscription at any time through your account dashboard or by emailing [email protected].

Custom-Printed Books, Canvases & Coloring Books

  • Defective or Damaged Items Only: Our physical printed teacher curriculum guides, student workbooks, canvases, canvas kits, and bound coloring books are custom-manufactured and printed to order. Consequently, we do not accept returns or exchanges for change of mind or accidental orders.
  • Replacement Policy: If your physical printed teacher curriculum guides, student workbooks, canvases, canvas kits, and bound coloring books arrive physically damaged, misprinted, or defective due to a manufacturing error, we will issue a replacement at no additional cost. 
  • How to Request a Replacement: You must email [email protected] within seven (7) days of delivery. Your email must include your original order number, a brief description of the issue, and clear photographic evidence of the damaged or defective items.  When we replace the damaged items, we will include a shipping label for you to return the damaged items.

 

  1. 13. Children's Online Privacy Protection Act of 1998 (FTC)

 

State and Federal Consumer Privacy Compliance (COPPA, CCPA, CPRA): Fun Art Box®, LLC complies stringently with the Children’s Online Privacy Protection Act (COPPA), the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and all corresponding state-level comprehensive data privacy laws.

  • Minor Privacy: Our platform does not knowingly collect, harvest, solicit, or maintain personally identifiable information (PII) from children under the age of thirteen (13).

15.1 Lawful Use and Storefront Conduct: By accessing FunArtBox.com or utilizing our digital storefront, you covenant and agree to use our online platform strictly for lawful, non-commercial purposes. You are entirely responsible for maintaining the confidentiality of any account credentials, passwords, and digital license keys issued to you, and you assume full liability for all activities that occur under your user profile.

15.2 Prohibited Online Activities: Users are strictly prohibited from engaging in any malicious or unauthorized interference with our web operations. Prohibited conduct includes, but is not limited to:

  • Deploying automated data-mining tools, scraping software, spiders, or robots to extract curriculum text, custom hand-drawn imagery, or video streams.
  • Uploading or transmitting malicious code, viruses, worms, malware, or Trojan horses designed to disrupt or corrupt our site functionality.
  • Attempting to bypass, disable, or circumvent any digital rights management (DRM) protections, password gates, or encryption protocols guarding our downloadable PDFs or digital video library.
  • Utilizing our contact forms, checkout systems, or review portals to distribute spam, unauthorized advertising, or defamatory content.

15.3 Termination of Web Access: Fun Art Box®, LLC retains the unilateral, absolute right to monitor website traffic and user activity. We reserve the right to temporarily suspend or permanently terminate your digital account, platform access, and video library streaming tokens without prior notice or refund if we detect activity indicating a breach of these online rules, data scraping, or license-sharing.

 

  1. CLASSIFICATION OF CUSTOMERS: B2C AND B2B OPERATIONAL RULES

16.1 Business-to-Consumer (B2C) Terms (Parents & Independent Educators):

Transactions categorized as Business-to-Consumer (B2C) encompass purchases made by individual parents, legal guardians, homeschool instructors, or individual classroom teachers using personal funds for private or immediate single-classroom use.

  • Standard Grant: All B2C purchases are bound strictly to the Single-User, Non-Profit License outlined in Section 3 of these Terms.
  • Prohibition on Sharing: B2C buyers are explicitly prohibited from sharing digital accounts, login keys, or video library access tokens with colleagues, relative households, or school-wide networks.
  • Payment Terms: B2C transactions require immediate, full payment at digital checkout via authorized credit card, debit card, or electronic payment processors prior to the delivery of digital assets or fulfillment of physical canvas kits.

16.2 Business-to-Business (B2B) Terms (School Districts, Charters, & Institutions):

Transactions categorized as Business-to-Business (B2B) encompass purchases executed by public or private school districts, charter organizations, non-profit foundations, or educational institutions purchasing on behalf of multiple educators, buildings, or administrative tiers.

  • Multi-User Site Licenses: B2B purchasers must secure a formal Institutional Site License Contract specifying the exact headcount of authorized educators covered by the transaction.
  • Prohibition on District-Wide Servers: B2B buyers shall not host, upload, or index Fun Art Box®, LLC digital files (PDF curriculum guides, art history sheets, or coloring packs) on centralized intranet systems, district-wide networks, or open-access cloud drives. Every authorized educator must be issued a unique, individual login credential.
  • Corporate Governance & Purchase Orders (POs): B2B transactions may be initiated via a formal institutional Purchase Order (PO). Fun Art Box®, LLC offers net-30 day payment terms for verified institutions.
  • Purchase Orders: Digital delivery tokens and physical canvases will be withheld or locked if payment is not remitted within thirty (30) days of invoice issuance.
  • Institutional Liability: B2B entities accept joint and several liability for any copyright infringement or license-sharing violations committed by their employed educators or administrative staff using Fun Art Box®, LLC assets.

17.1 Business-to-Consumer (B2C) Terms of Commerce (Parents, Guardians, & Independent Educators):

Transactions categorized as Business-to-Consumer (B2C) encompass purchases executed by individual consumers—including parents, legal guardians, homeschool instructors, or independent classroom teachers utilizing personal funds—for private, non-commercial, single-household, or single-classroom educational enrichment.

  • Restrictive Grant of License: All B2C purchases are bound strictly and exclusively to the Single-User, Non-Profit License outlined in Section 3 of these Terms.
  • Prohibition on Single-Account Multi-User Leakage: B2C account holders are strictly prohibited from distributing, sharing, or assigning digital account credentials, video library tokens, or download links to professional colleagues, external households, or multi-classroom networks.
  • Payment and Fulfillment Controls: B2C transactions require immediate, unconditioned payment in full at electronic checkout via authorized credit card or verified digital payment processors. Fun Art Box®, LLC reserves the right to withhold digital delivery tokens and physical canvas kits until payment clearance is verified.

17.2 Business-to-Business (B2B) Terms of Commerce (School Districts, Charters, & Institutions):

Transactions categorized as Business-to-Business (B2B) encompass procurement agreements executed by corporate or government entities, including public school districts, private academies, charter school networks, non-profit foundations, or community organizations purchasing on behalf of multiple educators, facilities, or district-wide student bodies.

  • Institutional Licensing Mandate: B2B purchasers must enter into a formal, binding Institutional Site License Contract or purchase multiple individual seats explicitly declaring the precise headcount of authorized educators covered under the corporate transaction.
  • Server and Central Intranet Prohibition: B2B purchasers are strictly prohibited from hosting, storing, indexing, or displaying Fun Art Box®, LLC digital assets (including PDF curriculum guides, art history sheets, read-aloud files, and coloring packs) on centralized school servers, district-wide intranet networks, public-facing cloud folders, or shared drop-boxes. Every individual educator authorized under a B2B contract must be provisioned with unique, separate access credentials.
  • Purchase Orders (POs) and Institutional Invoicing: Verified B2B entities may initiate procurement via a formal institutional Purchase Order (PO). Fun Art Box®, LLC extends standard Net-30 Day payment terms to verified educational institutions upon PO approval. If the purchasing entity fails to remit payment within thirty (30) days of invoice issuance, Fun Art Box®, LLC retains the right to immediately lock or delete all associated digital teacher portals and suspend physical shipments without liability.
  • Institutional Indemnification and Liability: B2B purchasing organizations assume joint, several, and absolute liability for any copyright infringement, trademark violation, license-sharing breach, or digital piracy committed by their employed educators, administrative staff, or agents. The purchasing institution agrees to fully indemnify Fun Art Box®, LLC for all damages, court costs, and legal fees resulting from internal data leaks.

  • Artwork Only Submissions: Any submissions intended for our public family art gallery must feature the completed art project (canvas, coloring page, or craft) exclusively. Any submitted media containing an individual's face or physical identity will be immediately and permanently deleted without review.

We collect information that you voluntarily provide to us when purchasing our curriculum, creating an account, or communicating with us. This includes:

  • Account & Billing Data: First and last name, school district affiliation (if applicable), billing address, shipping address, email address, telephone number, and secure payment processing data.
  • User-Generated Content: Voluntary student artwork images, student first names, student ages/grades, and quotes outlining the joy or pride they experienced while creating, provided exclusively under an authorized parent/educator release form.

Our platform integrates industry-standard tracking codes, tags, pixels, and browser cookies deployed by third-party advertising networks, analytics providers, and affiliate platforms.

  • Operational Purpose: These tracking tools monitor outbound traffic patterns to identify user referrals. When you click an art supply link on our site, a temporary secure cookie is placed on your browser to register that Fun Art Box®, LLC is recommending the product.
